Design Commission - Minutes

CALL TO ORDER:
Acting Chair Pirzio-Biroli called the meeting to order at 7:05 PM in the Council Chambers, 9611 SE 36th Street, Mercer Island, Washington. 
 
ROLL CALL:
Acting Chair Lucia Pirzio-Biroli, and Commissioners Susanne Foster, Tami Szerlip, and Hui Tian were present.
 
STAFF PRESENT:
Shana Crick, Planner, and George Steirer, Principal Planner, were present.
 
MEETING MINUTES APPROVAL:
The minutes from the March 14, 2012 meeting were approved by consent.
 
REGULAR BUSINESS:
AGENDA ITEM #1 Public Hearing: Island Crest Way Apartments
Shana Crick, Planner, gave the staff presentation, which included a summary the conditions of preliminary approval. Ms. Crick also responded to questions from the Design Commission.
 
Acting Chair Pirzio-Biroli opened the public meeting and open record public hearing at 7:15 PM. John Weinberg of 3304 81st Place SE, Mercer Island, WA 98040 spoke to the Commission regarding the proposal. The Chair closed the public meeting and open record public hearing at 7:18 PM. 
 
Tom Gallagher (4243 Shoreclub Drive, Mercer Island, WA 98040) of Mercer Island Co-Investment, L.L.C. also addressed the Commission and responded to questions.
 
The Commission deliberated the proposal and asked additional questions of both the applicant and staff.
 
Commissioner Foster motioned to grant Mercer Island Co-Investment, L.L.C. final design approval for a proposed six unit multifamily development to be located at 3210 Island Crest Way as demonstrated in Exhibit 1 and as conditioned by the April 11, 2012 staff report to the Design Commission, provided that Exhibit 1 shall be modified as follows:
 
 

  1. If the applicant has not submitted a complete application for a building permit within two years from the date of the notice of the final design review decision, or within two years from the decision on appeal from the final design review decision, design review approval shall expire. The design commission may grant an extension for no longer than 12 months, for good cause shown, if a written request is submitted at least 30 days prior to the expiration date. The applicant is responsible for knowledge of the expiration date.
  2. All landscaping depicted in Sheet L1 of Exhibit 1 shall be maintained in good condition. Maintenance shall include regular watering, mowing, pruning, clearance of debris and weeds, removal and replacement of dead plants and the repair and replacement of irrigation systems. A landscaping bond is required prior to any Certificate of Occupancy for the proposed building to ensure that the approved landscape plan will achieve total coverage within three years after installation.  The bond amount shall be set by City staff based on the approved landscape plan, and cost for labor and materials.
  3. Prior to final building permit approval, the applicant shall provide to the City a scaled, detailed graphic illustrating the proposed sculpture.
  4. At the time of building permit submittal, provide to the City revised building elevations that reflect the modifications to the glass deck railings required by criterion number three above.

 
Acting Chair Lucia Pirzio-Biroli seconded the motion.
 
Acting Chair Lucia Pirzio-Biroli motioned to amend the original motion by adding an additional condition stating that the applicant shall obtain a co-easement for the pathway and stairway between the applicant and the property to the south for the pathway and the stairway down to the right-of-way that is mutually agreed to by both owners.
 
Commissioner Szerlip seconded the amended motion.
 
The amended motion passed with four yeas and no nays.
 
The original motion was passed with four yeas and no nays. The approved motion reads as follows:
 
The Design Commission granted final design approval to the proposed six unit multifamily development to be located at 3210 Island Crest Way and as demonstrated in Exhibit 1 in the April 11, 2012 staff report for DSR11-025, subject to the following five (5) conditions of approval:
 
 

  1.   5. Prior to building permit approval, the applicant shall provide to the City a recorded co-easement with the property immediately adjacent to the south for the use and maintenance of the gravel pathway and stairway for pedestrian access to the right of way. 

 
 
 
OTHER BUSINESS:
A Council Liaison report was not given.
 
Principal Planner Steirer announced that this would likely be the last meeting for Vice-Chair Pirzio-Biroli and thanked her for her work and service to the community. Mr. Steirer also provided information to the Commission regarding development planned by the Mercer Island School District.
 
The next regularly scheduled meeting is May 23, 2012. The April 25, 2012 and May 9, 2012 meetings have been canceled. 
 
There are no scheduled Commissioner absences.
 
ADJOURNMENT: Vice Chair Pirzio-Biroli adjourned the meeting at 7:49 PM.
