Design Commission - Minutes

CALL TO ORDER:
Chair Richard Erwin called the meeting to order at 7:05 PM in the Council Chambers, 9611 SE 36th Street, Mercer Island, Washington. 
 
ROLL CALL:
Chair Richard Erwin, Commissioners Susanne Foster, Nadine Laszlo, Lara Sanderson, Tami Szerlip, and Hui Tian were present. Vice-Chair Colin Brandt was absent.
 
STAFF PRESENT:
George Steirer, Principal Planner; Kelly Leonard, Assistant City Attorney; and Travis Saunders, Planner were present.
 
MEETING MINUTES APPROVAL:
The Design Commission reviewed the minutes from the October 9, 2013 meeting. The minutes were approved unanimously as written.
 
REGULAR BUSINESS:
PUBLIC HEARING Eighteen Unit Multifamily Condominium Development at 2960 and 2970 76th Avenue SE (Final Design Review and Height Variance)
 
George Steirer provided a brief summary of the project and procedural information. 
 
Charlie Conner of Conner Homes, 846 108th Ave NE, Bellevue, WA 98004, provided an applicant presentation.
 
Steve Calhoon of Pace Engineers, 11255 Kirkland Way #300 Kirkland, WA 98033, provided an applicant presentation.
 
Rick Tolleshaug of Milbrandt Architects, 25 Central Way, Suite 210, Kirkland, WA 98033, provided an applicant presentation.
 
Steve Calhoon submitted a revised landscape plan to the commission.
 
George Steirer provided procedural information regarding the hearing.
 
Chair Erwin opened the public hearing at 7:42 pm.

Alan Boeker of Conner Homes, 846 108th Ave NE, Bellevue, WA 98004, presented a simulation of the visual impact of the additional building height.
 
The Commission asked questions of the applicant team regarding the visual impact simulation, removal of trees, entry signage, art, protection of sidewalks from tree roots, the planting plan, fencing, bicycle rack, parking stalls, the proposed courtyard, underground utilities in relation to street trees, and factors that might change the need for additional height beyond the variance request.

Commissioners Sanderson and Foster asked staff process related questions.
 
The Commission reviewed the variance criteria.
 
Kelly Leonard, Assistant City Attorney, clarified criterion c. of the criteria.
 
Commissioner Foster moved to approve the request for VAR13-002, a variance from the Mercer Island City Code (MICC 19.03.010(E)), which specifies the height for buildings in the underlying MF-2 zone, as specified in the attached and to be modified Sheet H1, Building Height Calculations with the following conditions:
 
  1. The proposal shall occur in substantial accordance with the attached Sheet H1, Building Height Calculations.
 
 
  1. Prior to construction, all required permits, including design review and building permits, must be obtained.
 
 
  1. Approval of this variance shall expire one year from the date of the decision if the activity approved by the permit is not exercised. Responsibility for knowledge of the expiration date shall be with the applicant.
 
Commissioner Szerlip seconded the motion.
 
George Steirer clarified the motion.
 
Commissioner Foster withdrew the motion.
 
 
 
 
Commissioner Foster moved approve to approved the request for VAR13-002, a variance from the Mercer Island City Code (MICC 19.03.010(E)), which specifies the height for buildings in the underlying MF-2 zone, as specified in the attached Sheet H1, Building Height Calculations.
 
Conditions of approval:
1. The proposal shall occur in substantial accordance with the attached Sheet H1, Building Height Calculations, except that units 1 and 2 are granted a variance of 4.8 and units 3 and 4 are granted a variance of 4.2 above the maximum building height.
2. Prior to construction, all required permits, including design review and building permits, must be obtained. 
3. Approval of this variance shall expire one year from the date of the decision if the activity approved by the permit is not exercised. Responsibility for knowledge of the expiration date shall be with the applicant.
Commissioner Szerlip seconded the motion.
 
The motion passed with 6 yeas and 0 nays.
 
Commissioner Foster moved Move to grant Conner Homes final design approval for a proposed 18 unit townhouse development as depicted in the exhibits to the October 22, 2013 staff report to the Design Commission, along with the staff recommended conditions of approval.
 
1.  If the applicant has not submitted a complete application for a building permit within two years from the date of the notice of the final design review decision, or within two years from the decision on appeal from the final design review decision, design review approval shall expire. The design commission may grant an extension for no longer than 12 months, for good cause shown, if a written request is submitted at least 30 days prior to the expiration date. The applicant is responsible for knowledge of the expiration date.
 
 
  1. The landscaping be planted so that perimeter plantings shall be clustered in areas to screen the utility structures.
 
 
  1. The applicant shall provide four foot high welded wire panels with cedar post where fences are proposed in the revised landscape plan to be submitted.
 
 
  1. If any of the significant trees are removed prior to Certificate of Occupancy, the applicant shall be required to replace the trees at a 5 to 1 ratio.
 
 
  1. All trees planted shall be six feet high at time of planting.
 
 
  1. A landscaping bond shall be required prior to any Temporary Certificate of Occupancy or Certificate of Occupancy for the proposed building to ensure that the approved landscape plan will achieve total coverage within three years after installation.  The bond amount shall be set by City staff based on the approved landscape plan, and cost for labor and materials.
 
Commissioner Szerlip seconded the motion.
 
The Commission discussed the motion.
 
The motion passed with 6 yeas and 0 nays.
 
The Commission took a brief recess.
 
Study Session Sound Transit Mercer Island Light Rail Station
 
Travis Saunders provided a brief introduction.
 
Cynthia Padilla of Sound Transit provided a progress presentation.
 
Christine Scharrer of Hewitt Architects provided an architectural overview presentation.
 
Jim Yamaguchi on Nakano Associates provided a presentation regarding landscaping.
 
The Commission provide feedback to Sound Transit regarding the starkness of the proposed acoustic walls, incorporating art into the structure, a request to add texture to the glass and metal of the building, sheen of the floor tiles, rooftop turbines interfering with the clean lines of the building, acoustic wall treatment, glare issues of a metal panel at the entry, addition of backlighting to the bike cage wire mesh panel, addition of color in the floor tiles, removal of existing planter boxes and landscaping scheme, passenger drop off, the waterproofing system, and bus parking with drop off and pick up from Island Crest Way.  
 
OTHER BUSINESS:
A Council Liaison report was not given.
 
Staff had no additional comments.
 
The next regularly scheduled meeting is November 13, 2013.
