Design Commission - Minutes

Chair Richard Erwin called the meeting to order at 7:06 PM in the Council Chambers, 9611 SE 36th Street, Mercer Island, Washington. 
Chair Richard Erwin, Vice-Chair Colin Brandt, Commissioners Susanne Foster, Nadine Laszlo, Lara Sanderson, Tami Szerlip, and Hui Tian were present.
Christina Schuck, Assistant City Attorney, and Shana Crick, Senior Planner, were present.
The Design Commission reviewed the minutes from the March 26, 2014 meeting. Commissioner Szerlip motioned to approve the minutes. Commissioner Foster seconded the motion. The minutes were approved unanimously.
OPEN RECORD HEARING – Mercerwood Shore Club – 4150 East Mercer Way
The Assistant City Attorney, Christina Schuck, polled the Commission regarding appearance of fairness and potential ex parte contact.
Chair Erwin opened the open record hearing and administered a group oath to all parties offering testimony.
Shana Crick provided the staff report and responded to a question from the Design Commission.
Ed Weinstein of Weinstein A+U gave the applicant’s presentation and answered questions from the Design Commission. 
Landscape Architect, Karen Kiest, spoke to the Design Commission about the proposed landscaping.
Chair Erwin closed the public hearing at 7:34 PM.
Vice-Chair Brandt made a motion to grant the Mercerwood Shore Club final design approval for a new two story, 6,638 square foot clubhouse upon demolition of the existing clubhouse located at 4150 East Mercer Way, as shown in Exhibit 1, and as conditioned by the April 23, 2014 staff report to the Design Commission.
Commissioner Tian seconded the motion.
Vice-Chair Brandt motioned to amend the original motion to specify that design approval is subject to the following conditions of approval:
1.   If the applicant has not submitted a complete application for a building permit within two years from the date of the notice of the final design review decision, or within two years from the decision on appeal from the final design review decision, design review approval shall expire. The design commission or code official may grant an extension for no longer than 12 months, for good cause shown, if a written request is submitted at least 30 days prior to the expiration date. The applicant is responsible for knowledge of the expiration date.
2.   All landscaping depicted in Sheets L101 and L102 of Exhibit 1 shall be maintained in good condition. Maintenance shall include regular watering, mowing, pruning, clearance of debris and weeds, removal and replacement of dead plants and the repair and replacement of irrigation systems. A landscaping bond is required prior to any Temporary Certificate of Occupancy or Certificate of Occupancy (whichever is issued first) for the proposed building to ensure that the approved landscape plan will achieve total coverage within three years after installation.  The bond amount shall be set by City staff based on the approved landscape plan, and cost for labor and materials.
3.   Landscaping planted adjacent to intersections shall be maintained so that it does not create any site obstructions that block the view of the intersection and create safety hazards.
Commissioner Tian seconded the amended motion.
The amended motion was approved with six yeas and 0 nays.
The original motion was also approved with six yeas and 0 nays.
Staff had no additional comments.
There will be no meeting on May 14, 2014. The next regularly scheduled meeting is May 28, 2014. There are no scheduled absences.
ADJOURNMENT: Chair Erwin adjourned the meeting at 8:42 PM.
