Action Item #1. Final Design Review and Approval for new construction of Island Market Square, a residential/office/commercial mixed-use project at 2760 78th Avenue SE in the Town Center, submitted by SECO Development. (DSR 0010-004 and SEP 0010-002)
Richard Hart, DSG Director, summarized the staff report for the mixed-use project. The Commission had a few questions for clarification.
The Chairman decided to allow public comment before a presentation and dialogue with the applicant. John Bruns, 8251 SE 26th St, Mercer Island offered comments and stated three concerns about how the City would address fire safety to the residential units, traffic congestion and parking, and blockage of streets and sidewalks during the long construction period. Staff addressed the issues and indicated they have been discussed and would be handled through SEPA and final building permit review and approval.
The applicant presented information to clarify and explain all the points raised by the Design Commission during the preliminary design approval. Bill Stalzer, project planner, Larry Smart, landscape architect, and Jim Bodoia, chief architect spoke for the applicant and explained their response to each point requested by the Design Commission.
The Design Commission then asked questions and had discussions with the applicant and staff about the following: the mid-block pedestrian connection issue, use of the interior residential courtyard, signs and a sign program for the commercial uses, landscaping for the courtyard, and the redesign of the southwest corner of the building at 28th St. and 78th Ave
Commissioners Glick and Dawson expressed a concern over the lack of providing a mid-block pedestrian connection between 27th and 28th Streets and at least allowing pedestrian access through this courtyard during the daytime.
The Design Commission then reached a consensus, with Commissionerís Glick and Dawson dissenting, and concluded the courtyard should remain private for use of the residents.
The Design Commission concluded the project was ready for final approval.
Motion Commissioner Laszlo moved, 2nd by Commissioner Wittman, to recommend final design approval for the construction of a new Island Market Square mixed-use development as presented on formal site plans, dated July 16, 2001, with revisions dated November 7, 2001, incorporating the findings and conclusions of the Staff Report, and in accordance with Title 19, Mercer Island Town Center District Development requirements, Division II, part 1, 2, and 3, and Section 19.15.040 (H) of the Mercer Island Unified Land Development Code, with the following conditions:
- Submission of a landscape security agreement in the amount approved by the Development Services Department for the duration of two years from date of final certificate of occupancy inspection.
- Compliance with all conditions listed on the MDNS issued on September 11, 2001.
- Development and building plans shall comply with the original site plans, elevations, sections, landscaping and narrative submitted July 16, 2001, with any revisions submitted and approved on November 7, 2001 or November 15, 2001.
- Final approval with conditions is granted for 2 years from the expiration date of the appeal period, or if an appeal is filed, from the date of a final decision on any appeal with the availability of a one-year extension by the City upon submission by the applicant of reasonable justification for such extension and approval by the City.
The motion passed by a vote of 3-2.
Director Hart had no comments.
